1. GENERAL PROVISIONS

1.1. This User Agreement (hereinafter referred to as the Agreement) applies to the website of the Arkadia Store online store, located at

the address www.arkadia.store, and to all relevant sites linked to it.

1.2. The Arkadia Store online store website (hereinafter referred to as the Website) is the property of Arkadia Store.

1.3. This Agreement governs the relationship between the Website Administration of the Arkadia Store online store (hereinafter referred to as the Website Administration) and the User of this Website.

1.4. The Website Administration reserves the right to change, add, or remove clauses of this Agreement at any time without notifying the User.

1.5. Continued use of the Website by the User means acceptance of the Agreement and changes made to this Agreement.

1.6. The User is personally responsible for checking this Agreement for changes.

2. DEFINITIONS

2.1. The following terms have the following meanings for the purposes of this Agreement:

2.1.1 "Arkadia Store" – an online store located on the domain name www.arkadia.store, conducting its activities through the Internet resource and related services.

2.1.2. Online Store – a website that contains information about the Goods, the Seller, allowing you to make a selection, order, and (or) purchase the Goods.

2.1.3. Website Administration of the Online Store – authorized employees to manage the Website, acting on behalf of Arkadia Store.

2.1.4. User of the Online Store website (hereinafter referred to as the User) – a person who has access to the Website via the Internet and uses the Website.

2.1.5. The content of the Online Store website (hereinafter referred to as the Content) – protected results of intellectual activity, including literary works, titles, prefaces, annotations, articles, illustrations, covers, musical works with or without text, graphic, textual, photographic, derivative, composite, and other works, user interfaces, visual interfaces, trademarks, logos, computer programs, databases, as well as the design, structure, selection, coordination, appearance, general style, and layout of this Content, part of the Website, and other intellectual property objects, whether individually or in combination, contained on the Online Store website.

3. SUBJECT OF THE AGREEMENT

3.1. The subject of this Agreement is to provide the User with access to the Goods and services available on the Website.

3.1.1. The online store provides the User with the following types of services (services):

• access to electronic content with the right to purchase content;
• access to search and navigation tools of the online store;
• providing the User with the opportunity to post messages, comments, reviews, and rate the content of the online store;
• access to information about the Goods and information about purchasing the Goods on a paid basis;
• other types of services implemented on the pages of the online store.

3.1.2. This Agreement applies to all existing (actually functioning) services (services) of the online store at the moment, as well as any subsequent modifications and additional services (services) that appear in the future.

3.2. Access to the online store is provided free of charge.

3.3. This Agreement is a public offer. By accessing the Website, the User is deemed to have joined this Agreement.

3.4. The use of materials and services of the Website is governed by the laws of the Republic of Latvia.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. The Website Administration has the right to:

4.1.1. Change the rules for using the Website and change the content of this Website. The changes take effect from the moment the new version of the Agreement is published on the Website.

4.1.2. Restrict access to the Website if the User violates the terms of this Agreement.

4.2. The User has the right to:

4.2.1. Use all the services available on the Website, as well as purchase any Goods offered on the Website.

4.2.2. Ask any questions related to the services of the online store.

4.2.3. Use the Website exclusively for purposes and in a manner provided for by the Agreement and not prohibited by the laws of the Republic of Latvia.

4.3. The User of the Website undertakes to:

4.3.1. Provide additional information at the request of the Website Administration, which is directly related to the services provided by this Website.

4.3.2. Respect the property and non-property rights of authors and other rights holders when using the Website.

4.3.3. Refrain from any actions that may be considered as disrupting the normal operation of the Website.

4.3.4. Not disseminate using the Website any confidential and protected information about individuals or legal entities protected by the laws of the Republic of Latvia.

4.3.5. Avoid any actions that may result in the breach of confidentiality of information protected by the laws of the Republic of Latvia.

4.3.6. Not use the Website for distributing advertising information without the consent of the Website Administration.

4.3.7. Not use the services of the online store for the purpose of:

4.3.7.1. Uploading content that is illegal, violates any rights of third parties, promotes violence, cruelty, hatred, and (or) discrimination on racial, national, sexual, religious, social grounds, contains false information and (or) insults against specific persons, organizations, or government authorities.

4.3.7.2. Incitement to commit unlawful acts, as well as assisting individuals whose actions are aimed at violating the restrictions and prohibitions in force on the territory of the Republic of Latvia.

4.3.7.3. Violating the rights of minors and (or) harming them in any form.

4.3.7.4. Violating the rights of minorities.

4.3.7.5. Presenting oneself as another person or representative of an organization and (or) community without sufficient rights, including for employees of this online store.

4.3.7.6. Misleading about the properties and characteristics of any Goods from the catalog of the online store posted on the Website.

4.3.7.7. Incorrect comparison of Goods, as well as forming a negative attitude towards persons (not) using certain Goods, or condemnation of such persons.

4.4. The User is prohibited from:

4.4.1. Using any devices, programs, procedures, algorithms, and methods, automatic devices, or equivalent manual processes to access, acquire, copy or track the content of this online store Website.

4.4.2. Disrupting the proper functioning of the Website;

4.4.3. Bypassing the Website's navigation structure to obtain or attempt to obtain any information, documents, or materials by any means that are not specifically provided by the services of this Website.

4.4.4. Unauthorized access to the functions of the Website, any other systems or networks related to this Website, as well as any services offered on the Website.

4.4.5. Violating the security or authentication system on the Website or any network related to the Website.

4.4.6. Performing reverse searches, tracking, or attempting to track any information about any other User of the Website.

4.4.7. Using the Website and its Content for any purposes prohibited by the laws of the Republic of Latvia, as well as inciting any illegal activity or other activity that violates the rights of the online store or other persons.

5. USE OF THE ONLINE STORE WEBSITE

5.1. The Website and the Content that is part of the Website are owned and managed by the Website Administration.

5.2. The content of the Website cannot be copied, published, reproduced, transmitted, or distributed in any way, nor placed on the Internet without the prior written consent of the Website Administration.

5.3. The content of the Website is protected by copyright, trademark laws, and other rights related to intellectual property and unfair competition laws.

5.4. Purchase of the Goods offered on the Website may require the creation of a User account.

5.5. The User is personally responsible for maintaining the confidentiality of account information, including the password, as well as for all activities carried out on behalf of the registered User account.

5.6. The User must immediately notify the Website Administration of unauthorized use of their account or password or any other security breach.

5.7. The Website Administration has the right to unilaterally cancel the User account if it has not been used for more than 24 calendar months in a row without notifying the User.

5.8. This Agreement applies to all additional terms and conditions of purchase of Goods and services provided on the Website.

5.9. Information posted on the Website should not be interpreted as an amendment to this Agreement.

5.10. The Website Administration has the right to make changes to the list of Goods offered on the Website and (or) the prices applicable to such Goods at any time without notifying the User.

5.11. The documents listed in clauses 5.11.1–5.11.3 are regulated in the relevant section and are an integral part of this Agreement:

• 5.11.1. Privacy Policy;
• 5.11.2. Agreement on the purchase of goods;
• 5.11.3. Proposals and comments.

6. LIABILITY

6.1. Any losses that the User may incur in the event of intentional or reckless violation of any provision of this Agreement, as well as due to unauthorized access to the communications of another User, the Website Administration shall not be compensated.

6.2. The Website Administration is not responsible for:

6.2.1. Delays or failures in the process of performing operations that occurred due to force majeure, as well as any case of malfunctions in telecommunications, computer, electrical, and other related systems.

6.2.2. Actions of transfer systems, banks, payment systems, and delays associated with their work.

6.2.3. Proper functioning of the Website if the User does not have the necessary technical means to use it, and also does not bear any obligations to provide users with such means.

7. VIOLATION OF THE TERMS OF THE USER AGREEMENT

7.1. The Website Administration has the right to disclose any information collected about the User of this Website if disclosure is necessary in connection with an investigation or complaint regarding the misuse of the Website or to identify (determine) a User who may violate or interfere with the rights of the Website Administration or the rights of other Website Users.

7.2. The Website Administration has the right to disclose any information about the User that it deems necessary to comply with applicable laws or court orders, to ensure compliance with the terms of this Agreement, or to protect the rights, property, or safety of Arkadia Store, its Users, or the public.

7.3. The Website Administration has the right to disclose information about the User if applicable law requires or permits such disclosure.

7.4. The Website Administration has the right to terminate and (or) block access to the Website without prior notice to the User if the User has violated this Agreement or the terms of using the Website contained in other documents, as well as in case of termination of the Website or due to a technical problem or issue.

7.5. The Website Administration is not responsible to the User or third parties for the termination of access to the Website in the event of violation by the User of any provision of this Agreement or other document containing the conditions for using the Website.

8. DISPUTE RESOLUTION

8.1. In the event of any disagreement or dispute between the Parties to this Agreement, a prerequisite before applying to the court is the presentation of a claim (a written proposal for a voluntary settlement of the dispute).

8.2. The recipient of the claim within 30 calendar days from the date of its receipt shall notify the applicant in writing of the results of the claim review.

8.3. If it is impossible to resolve the dispute voluntarily, either Party has the right to apply to the court for the protection of their rights, which are granted to them by the current legislation of the Republic of Latvia.

9. ADDITIONAL CONDITIONS

9.1. The Website Administration does not accept counter offers from the User regarding changes to this User Agreement.

9.2. User reviews posted on the Website are not confidential information and can be used by the Website Administration without restrictions.
