This Privacy Policy (hereinafter – Privacy Policy) applies to all information that the online store “Arkadia Store”, located at the domain name www.arkadia.store, may obtain about the User during the use of the website, programs, and products of the online store.


1. DEFINITIONS

1.1. In this Privacy Policy, the following terms are used:

1.1.1. “Website Administration of the Online Store (hereinafter – Website Administration)” – authorized employees managing the site, acting on behalf of Arkadia Store, who organize and (or) carry out the processing of personal data, and also determine the purposes of processing personal data, the composition of personal data to be processed, actions (operations) performed with personal data.

1.1.2. “Personal Data” – any information related to a directly or indirectly identified or identifiable individual (data subject).

1.1.3. “Processing of Personal Data” – any action (operation) or set of actions (operations) performed with the use of automation tools or without using such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.

1.1.4. “Confidentiality of Personal Data” – a requirement that must be adhered to by the Operator or any other person who has access to personal data not to disclose them without the consent of the data subject or other legal grounds.

1.1.5. “Website User of the Online Store (hereinafter – User)” – an individual who has access to the Site via the Internet and uses the Site of the online store.

1.1.6. “Cookies” – a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request when attempting to open a page of the corresponding site.

1.1.7. “IP Address” – a unique network address of a node in a computer network built according to the IP protocol.


2. GENERAL PROVISIONS

2.1. The use of the online store website by the User means acceptance of this Privacy Policy and the conditions for processing the User’s personal data.

2.2. If the User does not agree with the terms of the Privacy Policy, they should stop using the online store website.

2.3. This Privacy Policy applies only to the Arkadia Store website. The online store does not control and is not responsible for third-party websites that the User may access through links available on the online store website.

2.4. The Website Administration may verify the accuracy of the personal data provided by the User of the online store website.


3. SUBJECT OF THE PRIVACY POLICY

3.1. This Privacy Policy establishes the obligations of the Website Administration of the online store to maintain the confidentiality and protection of personal data provided by the User upon request from the Website Administration during registration on the online store website or when placing an order for the purchase of Goods.

3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out a registration form on the Arkadia Store website in the Registration section or when placing an order and includes the following information:

3.2.1. The User’s last name and first name;

3.2.2. The User’s contact phone number;

3.2.3. Email address (e-mail);

3.2.4. Delivery address;

3.2.5. Date of birth.

3.3. The online store protects Data that is automatically transmitted during the viewing of ad blocks and when visiting pages with a statistical script (or “pixel”):

  • IP address;
  • Information from cookies;
  • Information about the browser (or other program accessing the ad display);
  • Access time;
  • Page address where the ad block is located;
  • Referrer (address of the previous page).

3.3.1. Disabling cookies may result in the inability to access parts of the online store website that require authorization.

3.3.2. The online store collects statistics on the IP addresses of its visitors. This information is used to identify and resolve technical problems, to monitor the legality of financial transactions.

3.4. Any other personal information not mentioned above (purchase history, used browsers and operating systems, etc.) is subject to secure storage and non-disclosure, except as provided in paragraphs 5.2 and 5.3 of this Privacy Policy.


4. PURPOSES OF COLLECTING USER PERSONAL INFORMATION

4.1. The Website Administration of the online store may use the User’s personal data for the following purposes:

4.1.1. Identifying the User registered on the online store website for placing an order and/or concluding a remote purchase and sale agreement with Arkadia Store.

4.1.2. Providing the User with access to personalized resources of the online store website.

4.1.3. Establishing feedback with the User, including sending notifications, requests related to the use of the online store website, providing services, processing requests and applications from the User.

4.1.4. Determining the User’s location to ensure security, prevent fraud.

4.1.5. Confirming the accuracy and completeness of the personal data provided by the User.

4.1.6. Creating an account for making purchases, if the User consented to the creation of the account.

4.1.7. Notifying the User of the status of their Order.

4.1.8. Processing and receiving payments, confirming tax or tax benefits, disputing payments, determining the User’s right to obtain a credit line.

4.1.9. Providing the User with effective customer and technical support in case of problems related to the use of the online store website.

4.1.10. Providing the User, with their consent, with product updates, special offers, price information, newsletters, and other information on behalf of the online store or on behalf of the online store’s partners.

4.1.11. Conducting advertising activities with the User’s consent.

4.1.12. Providing the User with access to partner websites or services of the online store to receive products, updates, and services.


5. METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION

5.1. Processing of the User’s personal data is carried out without time limitation, by any legal means, including in personal data information systems with the use of automation tools or without such tools.

5.2. The User agrees that the Website Administration has the right to transfer personal data to third parties, including courier services, postal organizations, telecommunications operators, solely for the purpose of fulfilling the User’s order placed on the Arkadia Store website, including delivery of Goods.

5.3. The User’s personal data may be transferred to authorized government authorities of the Republic of Latvia only on the grounds and in the manner established by the legislation of the Republic of Latvia.

5.4. In the event of loss or disclosure of personal data, the Website Administration informs the User of the loss or disclosure of personal data.

5.5. The Website Administration takes necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other illegal actions by third parties.

5.6. The Website Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.


6. OBLIGATIONS OF THE PARTIES

6.1. The User must:

6.1.1. Provide personal data information necessary for using the online store website.

6.1.2. Update and supplement the provided personal data information in case of changes.

6.2. The Website Administration must:

6.2.1. Use the received information solely for the purposes specified in paragraph 4 of this Privacy Policy.

6.2.2. Keep confidential information secret, not disclose it without the User’s prior written consent, and not sell, exchange, publish, or disclose the User’s personal data in any other possible ways, except as provided in paragraphs 5.2 and 5.3 of this Privacy Policy.

6.2.3. Take precautionary measures to protect the confidentiality of the User’s personal data in accordance with the procedures commonly used to protect such information in the existing business turnover.

6.2.4. Block personal data relating to the relevant User upon request or appeal by the User or their legal representative or authorized data protection authority during the verification period in case of detection of inaccurate personal data or illegal actions.


7. LIABILITY OF THE PARTIES

7.1. The Website Administration that fails to fulfill its obligations is liable for the damages incurred by the User due to the unlawful use of personal data in accordance with the legislation of the Republic of Latvia, except as provided in paragraphs 5.2, 5.3, and 7.2 of this Privacy Policy.

7.2. In the event of loss or disclosure of Confidential Information, the Website Administration is not liable if this confidential information:

7.2.1. Became public knowledge before its loss or disclosure.

7.2.2. Was received from a third party before it was received by the Website Administration.

7.2.3. Was disclosed with the User’s consent.


8. DISPUTE RESOLUTION

8.1. Before filing a lawsuit regarding disputes arising from the relationship between the website User and the Website Administration, it is mandatory to submit a claim (written proposal for voluntary dispute resolution).

8.2. The recipient of the claim, within 30 calendar days from the date of receipt of the claim, shall notify the claimant in writing about the results of the claim review.

8.3. If an agreement is not reached, the dispute will be referred to the court in accordance with the current legislation of the Republic of Latvia.

8.4. This Privacy Policy and the relationship between the User and the Website Administration are governed by the current legislation of the Republic of Latvia.


9. ADDITIONAL TERMS

9.1. The Website Administration has the right to make changes to this Privacy Policy without the User’s consent.

9.2. The new Privacy Policy takes effect from the moment it is posted on the online store website unless otherwise provided by the new version of the Privacy Policy.
